<br> to be procured through competition only among domestic bidders
In accordance with sub-section (2) of Section 11 of the Act, when one-stage open bidding is called, in the procurement of construction work with an estimated cost of more than two million rupees and up to "one billion rupees, except in the case of Section 15 of the Act, the procurement shall be conducted through competition among domestic bidders only through open bidding at the national level. (2) In case of procurement according to sub-rule (1), the technical and financial proposals should be sealed in two separate envelopes, clearly indicating which proposal is outside each envelope, and both proposals should be sealed in another separate outer envelope and bids should be submitted. It should be disclosed in the related documents.
(3) While preparing the documents related to the bid according to sub-rule (2), the basis of qualification for proving the technical and economic and financial capacity as per rules 25, 26, 28 and 29 for the technical proposal shall be mentioned.
(4) The technical proposal as per sub-rule (3) shall be opened through the procedure as per section 32 of the Act and examined in accordance with section 23 and rules 59, 60, 62 and 63 and the effective bid shall be determined in essence.
(5) A bid that is successful on all grounds of eligibility as per sub-rule (4) shall be considered as a valid bid and all such successful bidders shall be notified of the place, date and time of opening of the financial proposal, giving them a period of at least seven days to attend at that date and time.< br> (6) According to sub-rule (4), the financial proposal of the bidder who fails on the basis of merit while evaluating the technical proposal shall be returned to the concerned bidder. But the financial offer of the bidder submitting the bid through the electronic procurement system will not be returned.
(7) In accordance with sub-rule (4) of the successful bidders, through the procedure as per rule 79, the financial proposal shall be opened and the lowest evaluated essentially effective bid shall be selected after economic and special evaluation in accordance with section 25 of the Act and rule 61, 64, 65 of the regulation.
